Minimum Wage to Increase in Missouri on January 1, 2007

Employees in Missouri must be paid at least $6.50 per hour effective January 1, 2007, as a result of a ballot measure that was overwhelmingly passed by Missouri voters (76% to 24%) on November 7, 2006.

Tipped Employees – Tipped employees must be paid at a rate of 50 percent of the new Missouri minimum wage, up to and including the full wage rate if the tips do not add up to the difference.

Overtime Pay – Under Missouri law, employers are required to pay employees overtime pay – at a rate not less than 1½ times the regular rate of pay – for hours worked after 40 hours a week. Employees of an amusement or recreation business are exempt from the overtime pay requirement, as are employees who are exempt from receiving overtime pay under federal law.

Small Farmers – Employees of small farmers are exempt from the Missouri minimum wage and overtime pay provisions if certain requirements are met.

Teenage Learners – The Missouri Department of Labor and Industrial Relations may set a wage rate in particular occupations that is not less than 90 cents below the Missouri minimum wage for learners and apprentices under 20 years of age who have not completed the required training for a particular job, but only after a public hearing is held and a regulation is issued.

Future Increases – The Missouri minimum wage will be increased (or decreased) on January 1, 2008 and on January 1 of successive years by the increase (or decrease) in the cost of living (rounded to the nearest five cents), as measured by changes to the Consumer Price Index (CPI-W) as of July of each year. The Missouri Department of Labor and Industrial Relations will announce any changes in the minimum wage on September 30 of each year.

If Federal Minimum Wage is Higher – The Missouri law requires employees to be paid the Missouri minimum wage or the federal minimum wage (which is currently $5.15), whichever is higher.
