Kansas Businesses Must Post Sign to Bar Concealed Handguns

Kansas employers, businesses and organizations who desire to prohibit concealed handguns in their buildings must post a new, 8"×8" color sign, according to guidance issued by the Kansas Attorney General on November 14, 2006.

Kansas Concealed Carry Law - Effective January 1, 2007, authorized Kansans will be able to lawfully carry concealed handguns, after the Kansas legislature on March 23, 2006 overrode Gov. Kathleen Sebelius’ veto, and passed the measure (SB 418) into law.

License Required - The State must issue a license to Kansans in order to carry a concealed weapon. Applicants must be over age 21, a citizen of the United States, a resident of Kansas for at least six months, and without a felony conviction or certain other criminal history. Applicants must also pay a fee, be fingerprinted and undergo approved weapons training.

Licenses to be Issued in January 2007 – The Kansas Department of Revenue will begin to issue concealed carry licenses to qualified Kansans on January 2, 2007. So far, more than 3,250 Kansans have applied for a concealed carry handgun license and of those applications received, 2,604 have been approved.

Restrictions on Carrying Concealed Weapons - Employers may restrict or prohibit the carrying of concealed weapons on its premises, or while engaged in the duties of employment. Businesses and property owners may also restrict or prohibit concealed weapons by posting a sign. Concealed weapons are also prohibited at several locations, including schools, libraries, places of worship, day care centers, athletic events, state office buildings and courtrooms.

Sign Requirements – Under the Kansas concealed carry sign regulations, each sign that is used to prohibit concealed handguns in buildings must meet all of the following requirements:

  • The size of the sign must be at least eight by eight inches, with the graphic at least six inches in diameter. If the sign is larger, then the graphic needs to be proportional in size.
  • The background must be white.
  • The graphic of the handgun must be black
  • The graphic of the circle and diagonal slash across the handgun must be red.
  • No text may be within the one-inch area surrounding the graphic.

Download Sign – Those wanting to post the concealed carry signs in their facilities may download the image from the Kansas Attorney General website.

Location of Sign – The signs must be displayed so those entering the building will likely see it.

Bottom Line - Employers who desire to prohibit employees from carrying concealed weapons on company property should post the required signs in addition to maintaining and communicating its regular rules, regulations and policies on such conduct.
